Penalties for Drug DWI in Texas

The penalties for drug-related DWI offenses in Texas depend on several factors, including the number of prior offenses and the type of drug involved.

  • Second Offense: A fine of up to $4,000, jail time ranging from 30 days to 1 year, driver's license suspension for up to 2 years, an annual fee of $1,000 to $2,000 for three years to retain driver's license
  • Third Offense (or more): A fine of up to $10,000, jail time ranging from 2 to 10 years, driver's license suspension for up to 2 years, an annual fee of $1,000 to $2,000 for three years to retain driver's license
