DWI Penalty Increases Distracted Driving

You may know that the drunk driving laws in Texas can be quite strict. Among the many potential penalties that a person accused of driving while intoxicated may experience is the requirement to install and use an ignition interlock device. For some people, the use of an IID is the only way that they are legally allowed to drive for a period of time after a DWI offense.

A report by Car and Driver magazine highlights how the use of an IID, a device touted as promoting improved safety by preventing repeat instances of drunk driving, may actually pose a serious risk to drivers and others on the roads. When using an ignition interlock device, a driver must take a breath test before their vehicle ignition is unlocked and able to be started, but that is not the only time they must use the IID.

An IID prompts a driver to take these breath tests at random times while actively driving. The driver has a limited amount of time in which to complete the test before alerts are initiated. A driver may not have the ability to pull over to meet the time limit so is forced into holding the device in their hands, reading the display versus watching the road and concentrating on the test instead of driving.
